Abstract

Bidding processes aim the acquisition of goods and services where there is use of public funds. Medicines and health inputs are marketed obeying specific laws and resolutions, being restricted to specialized marketing companies and technical responsibility of the pharmacist. But once purchased by bidding medicines and supplies to health shall be categorized as consumer products, applying the bidding legislation and no more specific legislation. This fact confirms that companies without the necessary technical qualifications, often belonging to another branch of activity, participate in bidding processes. Without appropriate qualifications technical responsibility on medicines and supplies to health are compromised, resulting in loss of quality of the process. One points of bidding process where the highest commitment occurs is in logistics, which in most cases is inadequate, causing loss of quality. Changes in temperature, rough handling and moisture variations expose the risks of drugs physicochemical commitment, having a direct effect on their therapeutic activity. In the description of a bidding process notice should obligatorily contain the technical and logistic responsibility for drugs and supplies. In a sample of 100 bidding processes demonstrates that specific legislation related to drugs and is not mentioned, opening gaps that can compromise the quality assurance in medicine, particularly in logistics.
